The Deputy Prime Minister, Le Minh Khai, has recently signed Decision No. 13/2023/QD-TTg, which establishes a list of scrap materials allowed for import as raw materials for production. The decision aims to regulate the importation of various scrap materials from foreign countries for use in production processes.
The permitted scrap materials for import as raw materials for production include: iron, steel, and cast iron scraps; plastic scraps and fragments; paper scraps; glass scraps; and colored metal scraps.
- Specifically, the iron, steel, and cast iron scraps include: scraps and fragments of cast iron (HS code 7204 10 00); scraps and fragments of alloy steel, including stainless steel (HS code 7204 21 00); scraps and fragments of other types of alloy steel (HS code 7204 29 00); scraps and fragments of tin-plated iron or steel (HS code 7204 30 00); other scraps and fragments, such as turnings, shavings, broken pieces, scale, sawdust, abrasive powder, cuttings, and punchings, whether or not compressed into blocks or bundled (HS code 7204 41 00); other scraps and fragments of iron or steel (HS code 7204 49 00).
- Plastic scraps and fragments include: foamed, non-rigid polyethylene polymers (HS code 3915 10 10); other polyethylene polymers (HS code 3915 10 90); other styrene polymers: Polystyrene (PS), Acrylonitrile Butadiene Styrene (ABS); High Impact Polystyrene (HIPS); Expanded Polystyrene (EPS) (HS code 3915 20 90).
- Paper scraps include: unbleached kraft paper or kraft paperboard, or paper or paperboard made primarily from unbleached pulp (HS code 4707 10 00); other paper or paperboard made mainly from pulp obtained by a chemical process, not colored throughout (HS code 4707 20 00); other paper or paperboard made mainly from mechanically processed pulp (e.g., newsprint, magazines, and similar publications) (HS code 4707 30 00).
Organizations and individuals directly importing scrap materials as raw materials for production are only allowed to import them for their own facilities, based on the designated production capacity to manufacture products and goods.
- Regarding the transitional provision, paper scraps with HS code 4707 90 00 are permitted to be imported from foreign countries based on the environmental component license (Confirmation of Environmental Protection Conditions for Importing Scrap Materials as Raw Materials for Production) that was issued by competent authorities before June 1, 2023, and remains valid until the expiration date of the environmental component license.
- Plastic scraps and fragments with HS code 3915 90 00 are allowed to be imported from foreign countries based on the environmental component license or the environmental license that was issued by competent authorities before June 1, 2023, and remains valid until the expiration date of the environmental component license or the environmental license, according to the corresponding HS codes specified in the list of permitted scrap materials for import as raw materials for production accompanying this Decision.
- Other types of scrap materials permitted for import from foreign countries based on the environmental component license or the environmental license issued by competent authorities before June 1, 2023, with different names (but with unchanged HS codes) compared to this Decision, can continue to be imported until the expiration date of the environmental component license or the environmental license.
This Decision comes into effect from June 1, 2023, and replaces Decision No. 28/2020/QD-TTg dated September 24, 2020, issued by the Prime Minister, which established the list of scrap materials allowed for import as raw materials for production.
Starting from June 1, 2023, the importation of small particle slag (sand slag) from iron or steel refining industries (HS code 2618 00 00) as raw materials for cement production will be carried out according to the regulations of the law on construction materials.
